Please read this privacy policy if you use the SONG CAKE website in any location

other than the USA, France, Italy, Spain, Portugal, Germany or Australia, which all have

their own privacy policies that you can find here.

As well as users of the SONG CAKE Platform, this privacy policy also applies to any

other individuals whose data we may process, except for our employees, candidates,

event partners and/or artists. If you are under these data subjects’ categories, please

check out the relevant privacy policy for you, which you can find here.

This privacy policy explains how SONG CAKE ENTERTAINMENT LTD uses your

personal information to provide the SONGCAKE. Occasionally, we might need to

update this policy, and will let you know of any updates in the Help Centre on the SONG

CAKE website. If we make any changes to the way we use your personal information,

we will let you know by posting a notice on theSONG CAKE website or sending you an

email at the email address provided at the time you registered.

1. ABOUT US

1.1 SONG CAKE is the trading name of SONGCAKE ENTERTAINMENT LIMITED,

Clarence St Chambers, 32 Clarence Street, Southend on Sea, Essex, SS11BD, United

Kingdom.

1.2. We are a creator of content for use on tv and radio and we sell tickets to our live

show recordings, via ticketing partners such as DICE..

2. OVERVIEW

2.1. For the purpose of the EU General Data Protection Regulation (the β€œGDPR”) (and

any other applicable UK laws, such as the UK GDPR), SONG CAKE is the β€œData

Controller” when you are on any of our platforms

2.2. SONG CAKE and its ticketing Partners are not joint controllers, except in certain

situations in which the data is controlled jointly (for example with regards to

pixels/cookies on third party websites). DICE is an agent, and the SONG CAKE are

data controllers, and they also own your data.2.3. This privacy policy explains how we use your personal information and other data

we collect when you use the SONG CAKE Platform.

3. THE BASIS FOR THE PROCESSING OF YOUR DATA

3.1. SONG CAKE processes your data to allow you to use, and us to deliver our

services to you. These services are governed by our Purchase Terms and Terms of

Use.

3.2. Some of your data will be processed based on SONG CAKE’s, Ticketing Partner's

or other third parties' legitimate interests, including photographs, and audio and video

recordings of events, to allow us to successfully provide the event experience set up for

you on the SONG CAKE Platform. Legitimate interest is also our lawful basis for

processing in-app analytics data (except where your consent is required) so we can

enhance and monitor app performance, account activity, or website logs etc, and

prevent fraudulent or other malicious activities, and produce website visitor logs for

cybersecurity and/or error tracking purposes. Legitimate interest is also our lawful basis

for profiling. We also rely on our legitimate interest to collect your date of birth, so we

can make sure you are allowed to purchase tickets, since some events will require you

to be at least 18, and to share some aggregated information with Ticketing Partners for

their own internal statistical and sales control purposes. We may also rely on legitimate

interest to share with our Ticketing Partners any personal information required for public

health reasons as per any legal obligation to which our Ticketing Partners are subject,

postal addresses for internal research purposes to help them understand their audience

better and in some circumstances, to share limited data with third parties based on their

legitimate interest, for example, where a ticket is re-sold to a third-party user on an

alternative platform. Legitimate interest is also our lawful basis for sending you any

post-event reviews or surveys to complete after you have attended an event, or after

you have contacted our Fan Support team, to help make SONG CAKE even better.

Where we are processing any personal data based on legitimate interest, we have

conducted a Legitimate Interest Assessment to ensure that the individual’s interests do

not override those legitimate interests and, where possible, if the processing involves

any sharing of your personal data with our Ticketing Partners or any third-party, the data

may be pseudonymised. We may also rely on legitimate interest for customer support

ticket analysis for the purposes of ensuring the quality of our support services and to

automate the work and enhance efficiency of our support team, through AI-powered

features.

3.3. We will ask for your consent if we need to share your data with third parties for any

reason not mentioned in this privacy policy which isn’t absolutely necessary for you to

be able to use SONG CAKE. We will also ask for your consent in some other cases, for

example in order to use your location to sync your music library or to send you

notifications, and to access your phone contact list under the β€˜Limited Right to Transfer

Tickets’ feature (see Clause 10 of our Purchase Terms), as well as for market research,or any other survey which doesn’t fall under post-event reviews, but of course you will

have a right to say no.

3.4. We may ask for your consent in other cases where we process your data. Y ou can

revoke your consent at any time by contacting us at help@songcake.net Please note

that the withdrawal of consent will not affect the lawfulness of processing based on

consent before the withdrawal.

3.5 We will rely on your explicit consent for processing special categories of personal

data when required for assigning Accessibility and PA tickets. We need this data in order

to fulfil your request, otherwise you can opt for standard tickets

4. COLLECTED INFORMATION

4.1. To help us manage your registration and ticket sales, we will process and store all

personal information you give when you register on the SONG CAKE Platform, and any

personal information which is generated when you navigate and use the SONG CAKE

Platform. We also use this information to analyse trends in your behaviour as this helps

us to determine your preferences, habits, tastes, geographic location and favourite

artists and events, which will maximise your use and enjoyment of the SONG CAKE

Platform; this is the Discovery feature.

4.2. The types of personal information we collect may include:

1. Contact details – including your name, gender, email address, phone number,

ID, postal address, and date of birth. Y ou will also have the option to add these

details for each ticket holder of a ticket purchased via the Ticketing Platform

(β€œAdditional User Data”), giving SONG CAKE or our Ticket Partner the ability to

contact each ticket holder after an event has occurred if it is required for public

health reasons. This is a safety precaution in case the organiser needs to contact

attendees. SONG CAKE will store this information up to 30 days after the event.

Please note that the Ticketing partner or venue may have defined a different

retention period, so please contact them or check their privacy policy for more

information.

2. Payment card and billing details – when you buy tickets or merchandise via

the SONG CAKE Platform, we will need your payment and billing information

(such as your address and postcode) so we can handle the processing and

despatch of ticket orders;

3. Location data – we may collect your IP address, and if you allow us to connect

to your device’s geolocation functionality, we may collect your GPS data. We will

use the location data to improve personalised recommendations on our Ticketing

Partner's Platforms on what events are taking place near you.

4. Your image or recordings – we might get photographs, audio or video

recordings of events listed on the SONG CAKE Platform to broadcast with live oras recordings and edited content. We may reproduce and/or publish your image,

or share this with all our Broadcasting Partners & platforms to reproduce and/or

publish (as part of a general photograph of video of an event) on the SONG

CAKE Platform and all other broadcast channels and platforms, apps and hosting

services,in other promotional materials, social networking channels and other

materials related to the SONG CAKE.

5. Your preferences – we may collect information about your purchase history,

events you have viewed, attended or enquired about, any events you have joined

a waiting list for, shared or invited people to attend and any feedback you may

give or reviews you may submit;

6. Music library (e.g. Spotify or Apple Music) – if you allow us to connect to your

music library, we may collect and hold information on your musical interests so

we can improve the personalised recommendations through our Ticketing partner

Platforms and invite you to artists special experiences;

7. Your interactions with us – for example if you send us information via email,

survey, social media, customer service communications or other methods, this

may be stored on our systems; and

8. Technical information – when you use the SONG CAKE website or store, we

automatically receive and record information on our server logs from your

browser or mobile platform, including the location, IP address, strictly necessary

cookie information and details about the page you requested. We also collect

information regarding your use of the SONG CAKE Platform, mobile device

information and browser information.

9. Feedback - when conducting a survey, we may collect your views, opinions and

suggestions.

10. Accessibility Data - Where required to manage Accessibility Seating or PA

tickets at your request, we may need to collect some evidence in order for us or

our Event Partners, Ticketing Partners or Venue Partners to be able to assign

them: front page of DLA/PIP/Attendance Allowance letter, Certificate of Vision

Impairment, Recognised Assistance Dog ID card, CredAbility Access Card, Blue

Badge, Doctors/medical and any other further information that may be necessary

on your personal needs, such as wheelchair access.

5. COOKIES

5.1. Our website and our app use cookies to distinguish you from other users of our

website and our app. This helps us to provide you with a good experience when you

browse our website and when you use our app and allows us to improve our site. A

cookie is a small file of letters and numbers that we store on your browser or the hard

drive of your device (if you agree). Cookies contain information that is transferred to your

device hard drive.

5.2. We use the following cookies on our website and/or our app:1. Strictly necessary cookies. These are cookies that we require to operate our

website and app. They include, for example, cookies that enable you to log into secure

areas of our website and app, use a shopping cart or make use of e-billing services. We

also include among these cookies a combination of Google Analytics and proprietary

tracking cookies that allow us to attribute purchases to partners, which is necessary for

us to be able to fulfil our obligations under these agreements as our business model

relies on it. This data is intended for internal use only and short expiry periods are set.

2. Analytical/performance cookies. These allow us to recognise and count the

number of visitors and to see how visitors move around our website and app when they

are using it. This helps us to improve the way our website and app works, for example,

by ensuring that users are finding what they are looking for easily.

3. Preference Cookies. These cookies help us to customise and improve your

experience. They are used to recognise important information about your preferences

so we can personalise our content for you. Although they are not vital for our website to

run, without them, certain functions of our website may not be available.

4. Targeting cookies. These cookies record your visit to our website, the pages you

have visited and the links you have followed. We will use this information to make our

website and the advertising displayed on it more relevant to your interests. We may also

share this information with third parties for this purpose. Where this information is used

for any marketing purposes, we will ask for your consent first.

5. Marketing cookies. These are cookies that are used to target advertising to a user

(behaviour targeting), including Facebook Conversion API through which data will be

shared with us and/or our Partners for marketing purposes, as well as being shared with

Facebook/Meta.

5.3. When you use our website for the first time you are given the opportunity to accept

or decline cookies which are not strictly necessary. By using the tick boxes on the

cookie banner, you are consenting to or declining our use of cookies by category as set

out in this policy. Y ou can also change your cookie consents at any time by accessing

the cookie banner. Y ou can set up your preferences the first time you visit our website

and at any time through our cookie banner.5.4 Please note that when you access or use our services through third-party websites,

such as our Ticketing and Venue Partners' websites, we may share some information

with them when you perform certain actions in the purchase flow. We will not use any

cookies or pixels for these purposes. These third parties or Event Partners will only be

able to use this data for marketing purposes if you provide your consent on their

website. We may not be able to erase your data in new sessions if there is no way for us

to identify you.

5.5 Y ou can delete all cookies that are already on your device by clearing the browsing

history of your browser. This will remove all cookies from all websites you have visited.

5.6 Our use of cookies is proportionate in relation to our intended outcome and limited

to what is necessary to achieve our purpose.

1. Session cookies. These cookies allow us to recognise and link the actions of a

user during a browsing session. They are temporary and expire at the end of a

browser session, normally when you exit the browser.

2. Persistent cookies. This category encompasses all cookies that are stored on a

user’s device in-between sessions. All persistent cookies have an expiration date

written into their code, but their duration can vary for each category or specific

cookie. The persistent cookies we use normally expire after six months.

6. USE OF YOUR PERSONAL INFORMATION

6.1. As well as the purposes described above at Clause 4.1, we use your personal

information to:1. run the SONG CAKE platforms or any other purposes required in order to allow

us to provide the SONG CAKE Platforms to you;

2. communicate with you via email, SMS, in-App notifications and push notifications

about your purchases on the SONG CAKE Platforms, including tickets (and the

events they relate to) and any other non-ticket items;

3. fulfil your orders for tickets and other non-ticket items purchased via SONG

CAKE Platforms;

4. provide better content, services, marketing, and support to you. For example, we

may need to use your information to administer your account or provide you with

information in connection with any purchases or events you have expressed an

interest in;

5. run and provide any competitions available to you via the SONG CAKE website

and communicate with you about those competitions. If entering into a

competition, please read the terms and conditions relating to that competition as

these may include specific terms regarding your personal data; and

6. to profile individual and demographic trends of events you attend or interest you

show in certain events and artists. This helps us to provide recommendations of

similar things you might like or find interesting. We do this by making

assumptions based on an analysis of the information we hold, including the

events you have viewed, waiting lists you have joined, and tickets you have

purchased. For example, if you purchased tickets to an event, we might show you

more events of this specific genre or type, or events by similar artists. In a similar

way, we may share your email address and other data such as your country or

your age with social media providers and search engines to show you and other

audiences more relevant ads on social media platforms that you are member of

and search engines you use.

6.2. We also use information that we collect about you to for operational purposes,

including:

1. to provide customer service, including to respond to your enquiries and answer

any of your requests for information, which may involve the use of AI-powered

features to streamline and optimise the process;

2. carry out verification checks, including to verify your identity when collecting

tickets at a venue, to check that you meet any minimum age requirements, or to

check that any restrictions on the reselling of tickets have been complied with;

3. to send you important information regarding our services, or other technical

notices, updates, security alerts, and support and administrative messages; and

4. as we believe to be necessary or appropriate under any applicable law, to

enforce our rights or to respond to requests from law enforcement and any other

government authorities.6.3. As explained in Clause 3, we use your personal data on the following legal bases:

1. your consent and your explicit consent where applicable;

2. as necessary to perform a contract that you have entered;

3. in our (or an Ticketing of Venue Partner’s or other third parties) legitimate

interests, including to improve the performance of the SONG CAKE Platform and

in order to enhance your experience.

4. to comply with a legal obligation.

6.4. Where we rely on your consent to process your personal data (e.g marketing), you

can withdraw your consent at any time by emailing us at help@songcake.net or in any

other way explained in this privacy policy. If you withdraw your consent, this will not

affect the lawfulness of any processing which took place before the withdrawal. When it

comes to Accessibility and PA tickets, please note that your explicit consent is

necessary for us or our Event Partners to be able to manage and fulfil your request.

Where this consent is not provided or provided and withdrawn later on, you may opt for

standard tickets.

7. MARKETING

7.1. We may send you marketing communications via email and push notifications. On

registration, we will ask you if you consent to (1) receiving updates about competitions,

prizes and what is going on at SONG CAKE, which can include updates about events,

artists, new features, merchandise, offers and more; and (2) taking part in surveys, fan

tests and more. Y ou can choose to opt in to marketing communications and push

notifications when registering on the SONG CAKE Platform. If you change your mind

about receiving any marketing emails from us, you can edit your preferences in the

communication controls centre in App (called β€˜Messages’) or unsubscribe from emails

by following the unsubscribe directions provided in the footer of each one. If you do not

want to receive push notifications from us, you can opt out by changing your

preferences in the β€˜Messages’ control centre in the App or change the appropriate

settings directly on your mobile device. To access the communication controls centre

(β€˜Messages’) you must have the App version 3.17.0 or above.

7.2. Where you opt out of receiving these marketing communications, we may still

process your personal data for other required purposes, as explained in Clauses 5 and

6 above.

7.3. On registration, we will also ask you if you consent to receive marketing messages

from our Ticketing or Venue Partners and other third parties involved in providing an

event you have purchased ticket(s) to. If you opt in to such marketing messages, we willpass your details, such as email address, city or full residence, full name and date of

birth to the relevant Event Partner or third party so that they can contact you for this

purpose. If you change your mind and do not want to receive such marketing messages,

you can opt out by contacting that third party directly or by unsubscribing using any

available β€˜unsubscribe’ link or similar in that third party’s emails to you. Alternatively, to

opt out of marketing messages from all third parties, you could edit your preferences in

the communication controls centre in the App (called β€˜Messages’). We will notify the

relevant third parties of your change in preferences, normally within 7 business days.

Note that it may take longer for each third party to action your request.

7.4. On registration, we will also ask you if you consent to take part in surveys, fan tests

and more.

8. DISCLOSURE OF YOUR INFORMATION

8.1. We will not rent or sell your personal information to anyone without your explicit

consent, but, so we can perform our part of our contract with you based on our Terms

and Conditions and our legitimate interests, we may share your personal information in

the ways described below. In some cases, these parties act as independent controllers,

and their own separate privacy policies may apply to the processing of your personal

data.

1. Agents and suppliers – We employ other companies/individuals to perform

functions on our behalf, for example our payment processing suppliers and data

analytics services providers and ticketing and broadcast Partners. We do not

share your personal information with our agents or suppliers except as is

necessary to enable them to provide us with a service.

We may disclose your personal data to the following categories of third-party recipients:

However, under some circumstances, Stripe

may also act as a controller, for example when

monitoring, preventing and detecting fraudulent

payment transactions or when improving their

Messaging and

collaboration tools

We may share your personal data with

messaging and collaboration software

providers.

Online survey tools We may share your personal data with online

survey tool service providers.

2. Third Parties – We may integrate with other third party products and services such

as Spotify or other ticketing providers to enable certain features of the SONG CAKE

Platform or enable access to the tickets via another provider. We do not share yourpersonal information with them except as is necessary in order to allow them to perform

the features requiring their integration.

3. Competition partners – When offering competitions or other prize draws, via the

SONG CAKE Platform, we may process your personal data in order to manage your

entry and contact you if you are a winner. We may share your name and country of

residence with anyone who asks for the winner's details, and we may use your name

and image in publicity materials as we see fit. We may share your personal information

with our competition partner to allow them to administer the competition (e.g. arranging

for the prize to be provided to the winner).

4. Tickets Partners – We are an event organiser and ticket seller, so we sell you tickets

to events either directly from our SONG CAKE platform or via our Ticketing Partner for

that event. Because of this, under some circumstances, we need to share your personal

details with these Ticketing Partners as well as with other parties involved in the

provision of the event (such as the venue). These include:

First name, last name, email address, phone number, ticket type and time

of purchase for operational purposes so Event Partners can provide you

with relevant information about the event including last minute changes

and/or cancellations, or for the purposes of ticket validation when you

enter a venue, on the basis of contract;

Location information, postal address, age and ticket purchase history for

audience analysis, sales control and aggregated statistics on the basis of

legitimate interest;

Any personal information required for public health reasons as per any

legal obligation to which our Ticketing Partners are subject on the basis of

third-party’s legitimate interest;

Any other information which we may need to share to comply with a legal

requirement;

marketing when signing up with SONG CAKE or our Ticketing or Venue or

Broadcast Partners.

needs and carer name where necessary to manage Accessibility and PA

tickets.

Order information when access to a third-party event-specific app or

website is required to access the tickets, where applicable as indicated

before and after purchase.We are not responsible or liable for the actions of any third parties. Should you wish to

complain about the use of your personal information by any third party, then you should

contact them directly.

5. Artists - If you follow an artist using our Ticketing Partner’s App, we may also share

your information with them. We are not responsible or liable for the actions of any third

parties, and if you wish to complain about the use of your personal information by any

third party then you should contact them directly.

6. Venues - If you follow a venue using ourTicketing Partner’s or Venue App, we may

also share your information with them. We are not responsible or liable for the actions of

any third parties, and if you wish to complain about the use of your personal information

by any third party then you should contact them directly.

7. Cookie Providers - where third-party cookies or similar technologies are used, we

may share your data with the relevant cookie provider if you have consented to the

cookie being set. Please see clause 5 for further information.

8. Other reasons – We may also share your personal information with a purchaser or

potential purchaser of our business and in some circumstances, we may have to

disclose your personal information by law, either because a court or the police or other

law enforcement agency has asked us for it, to enforce our legal rights, or to prevent

fraud or ticket-touting for example.

8.2. We may also provide our partners with anonymous information about how users,

collectively, use the App and website so that they can understand how often people use

their services, the App and the website.

9. INFORMATION ABOUT OTHER INDIVIDUALS

9.1. If you give us information (including personal information) on behalf of someone

else, you confirm that the other person has given you permission to act on their behalf

and has agreed that you can:

1. provide their personal information to us;

2. receive on their behalf any data protection notices; and

3. give consent to the transfer of their personal data abroad.

9.2. We will need to see proof of this consent, so will ask you to provide SONG CAKE

with the written authorisation from them or the document which demonstrates power to

represent them. If these documents are not available, we will be able to accept any

appropriate alternatives.9.3. Where personal data has not been obtained from a data subject, this privacy policy

explains how their data is processed.

10. SECURITY AND INTERNATIONAL TRANSFERS OF DATA

10.1. We are committed to ensuring that your information will be treated confidentially

and securely, and we have put in place appropriate measures to ensure the security of

your personal data.

10.2. The personal data that we collect from you may be transferred to, and stored at,

destinations outside the European Economic Area (EEA) where the laws on processing

personal data may be less stringent than in your country. It may also be processed by

staff operating outside the EEA who work for us or for one of our agents or suppliers.

10.3. Presently, personal data collected from you is stored in data centres as well as

cloud networks which are located or hosted in Ireland.

10.4. When your personal data is transferred to parties located outside of the EEA we

will assess and take appropriate measures to ensure these third parties provide

adequate security of such personal data and respect your rights to privacy. These

safeguards are intended to ensure a similar degree of protection to your data wherever

it may be transferred and may include:

1. only transferring your personal data to countries which have been deemed to

provide an adequate level of protection for personal data by the European

Commission; or

2. entering into specific contractual terms which have been approved by the

European Commission and which give personal data the same protection as

within the EEA (for example, if transferring your data to the USA).

11. DATA RETENTION

11.1. We may hold on to your personal data for as long as we need to for the purposes

for which it is processed or as is otherwise required by applicable law. If you terminate

your account on the App and/or website, stop using the SONG CAKE Platform, or our

agreement with you under the Terms of Use is terminated, we will delete your

information as it is no longer relevant, but we might need to continue to process your

personal data as required under applicable law, in order to establish, exercise or defend

legal claims where relevant.

11.2. We calculate the appropriate retention period for your data by considering the

nature and sensitivity of the data, the purposes for which we are processing the data,and any applicable statutory retention periods. Using these criteria, we regularly review

the personal data which we hold and the purposes for which it is held and processed.

Once processing has been completed, we may securely delete or anonymise your

personal data.

11.3. We may delete your account or specific information before deactivating your

account if we believe it may no longer be relevant. Purchase history may be deleted

after 6 years.

11.4 Retention in cases of fraud or breach of terms. Notwithstanding the provisions

above, if your account is terminated or blocked by us because you have committed fraud

or a material breach of our Purchase Terms (for example, by commercially reselling

tickets in violation of our terms), we have a legitimate interest in retaining a limited

amount of your personal data for a longer period. This is necessary to protect SONG

CAKE, our partners and other fans from future harm, to enforce our terms and for the

establishment, exercise or defence of legal claims. In these circumstances, we will retain

the minimum data necessary to identify you and prevent you from creating a new

account to repeat the misconduct. Due to the necessity of this processing, we may be

unable to comply with a request to erase this specific data during the time needed for

the stated purposes.

12. YOUR RIGHTS

Under the GDPR and any equivalent rules in the UK, you are entitled to certain rights
